Information on privacy and personal data processing pursuant to Art. 13 of Legislative Decree 196/2003 and Art. 13 of EU Regulation 2016/679 (GDPR).

I - Information regarding the Privacy Policy

This section contains information regarding how TRE D S.r.l. Unipersonale manages the processing of user data.

This privacy policy is also valid for the purposes of Art. 13 of Italian Legislative Decree no. 196/2003 (Code concerning the protection of personal data, as amended by Legislative Decree 101/2018) and Art. 13 of EU Regulation no. 2016/679 (GDPR), concerning the protection of natural persons with regard to the processing of personal data as well as the free movement of such data, for individuals interacting with TRE D S.r.l. Unipersonale.

This notice is provided for the use of the software designated as “TDS” (and associated platforms/services) and the website www.tredlab.it, as well as any subdomains connected to it that may be visited by the user via links contained therein.

The purpose of this document is to provide indications regarding the methods, timing, and nature of the information that data controllers must provide to users when connecting to the web pages of www.tredlab.it and using TDS software, regardless of the purposes of the connection, under Italian and European legislation.

This privacy policy may undergo modifications due to the introduction of new regulations or the evolution of services; users are therefore invited to consult this page periodically.

If the user is under 16 years of age, pursuant to Art. 8, para. 1 of EU Regulation 2016/679, they must validate their consent through parental or legal guardian authorization.

The data controller is the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. It also manages security aspects.

2 - Data Processor

The data processor is the natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.

Pursuant to Article 28 of EU Regulation no. 2016/679, upon designation by the data controller, the data processor for TDS software and www.tredlab.it is TRE D S.r.l. Unipersonale (together with any external processors duly appointed for specific services).

3 - Place of Data Processing

Data processing generated by the use of TDS software and www.tredlab.it takes place at the operating headquarters of TRE D S.r.l. Unipersonale located at Via delle Corti, Area PIP, 21 – 84085 Mercato San Severino (SA), Italy, and on server/cloud infrastructures of hosting providers located within the European Economic Area.

If necessary, data related to specific services (such as informational communications or newsletters) may be processed by the data processor or appointed personnel at their operational facilities.

III - Cookies

1 - Types of Cookies

The website www.tredlab.it and associated software (including the TDS software suite) use cookies to make user browsing experience easier and more intuitive: cookies are small text strings used to store certain information that may concern the user, their preferences, or the internet access device (computer, tablet, or smartphone) and are primarily used to adapt site operation to user expectations, providing a customized browsing experience and remembering choices made previously.

A cookie consists of a small set of data transferred to the user's browser by a web server and can only be read by the server that performed the transfer. It is not executable code and does not transmit viruses.

Cookies do not record confidential personal information and any identifiable data will not be stored without consent. If desired, saving some or all cookies can be disabled via browser settings. Third-party analytics cookies are used to collect information on user behavior on www.tredlab.it and subdomains in an anonymous and aggregated form, in order to monitor performance and improve usability. Any third-party profiling cookies are used to deliver relevant content aligned with user preferences.

IV - Processed Data

1 - Data Processing Methods

Like all websites, this website and related software make use of log files in which information collected automatically during user visits is stored. Collected information may include:

  • Internet Protocol (IP) address;
  • Browser type and device parameters used to connect to the site;
  • Internet Service Provider (ISP) name;
  • Date and timestamp of visit;
  • Referral and exit web pages;
  • Number of clicks and interactions where applicable.

The above information is processed automatically and collected in an exclusively aggregated form to ensure correct site operation and for security reasons, based on the legitimate interest of the data controller (Art. 6, para. 1, letter f GDPR).

For security purposes (anti-spam filters, firewalls, threat and virus detection), automatically recorded data may include personal data such as IP addresses, which could be used under applicable laws to prevent attempts to damage the site or harm other users, or other illegal activities. Such data is never used for user identification or profiling, but solely to protect the website and its users.

If the site allows message submission via forms or for specific user-requested services (including demo requests, commercial inquiries, or submitting a Curriculum Vitae for job positions), the system automatically detects and records identification details, including email address and contact details. Such data is provided voluntarily at the time of service request and used exclusively for fulfilling the request for the time strictly necessary.

Information that users choose to make public or transmit through available tools is provided knowingly and voluntarily, releasing TRE D S.r.l. from any liability regarding legal violations. It is the user's responsibility to verify that they have permission to input third-party personal data or protected content.

2 - Processing Purposes and Data Retention

Data collected during operation is used exclusively for the specified purposes and retained for the time strictly necessary to perform the activities, and in any case no longer than 5 years for technical logs and standard inquiries, and up to 10 years for statutory accounting and contractual documentation.

Data used for security purposes (blocking site damage attempts) is retained for the time strictly necessary to achieve that purpose.

3 - Data Provided by the User

As indicated above, the optional, explicit, and voluntary sending of emails to addresses indicated on this site or submitting contact forms entails the subsequent acquisition of the sender's address, necessary to respond to inquiries, as well as any other personal data included in the communication.

Specific summary notices will be progressively presented or displayed on pages dedicated to particular on-demand services.

4 - Support in Browser Configuration

Users can also manage cookies through their browser settings. However, deleting cookies from the browser may remove preferences configured for the site.

5 - Social Network Plugins and Links

The website www.tredlab.it also incorporates links, plugins, and buttons for social networks to allow easy sharing and viewing of content. These features are configured so that cookies are not set upon page load. Cookies may be set only when the user voluntarily interacts with the plugin or navigates to the external platform. Note that if the user is logged into the social network, they have already consented to cookies managed by that platform upon registration.

V - User Rights

Art. 13, para. 2 and Arts. 15–22 of EU Regulation 2016/679, as well as Art. 7 of Legislative Decree 196/2003, list the rights of data subjects.

The website www.tredlab.it and TRE D S.r.l. Unipersonale inform the user of the existence of the following rights:

  • Right to access personal data (Art. 15 EU Regulation), update them (Art. 7, para. 3, let. a Leg. Dec. 196/2003), rectify them (Art. 16 EU Regulation), supplement them, or restrict processing (Art. 18 EU Regulation), or object on legitimate grounds (Art. 21 EU Regulation), in addition to the right to data portability (Art. 20 EU Regulation);
  • Right to request erasure (Art. 17 EU Regulation), anonymization, or blocking of data processed in violation of law (Art. 7, para. 3, let. b Leg. Dec. 196/2003);
  • Right to obtain confirmation that updating, rectification, supplementation, erasure, or blocking operations have been notified to recipients of the data, unless this proves impossible or involves disproportionate effort (Art. 7, para. 3, let. c Leg. Dec. 196/2003);

Where processing is based on Art. 6(1)(a) – explicit consent – or Art. 9(2)(a) – explicit consent for special categories of data – the user has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent prior to withdrawal.

Likewise, in case of regulatory breach, the user has the right to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali - www.garanteprivacy.it) or the competent supervisory authority in their EU member state. www.garanteprivacy.it

VI - Security of Provided Data

This website treats user data lawfully and correctly, adopting appropriate technical and organizational security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of data. Processing is carried out using computer and IT tools with organizational logic strictly related to the declared purposes.

In addition to the data controller, authorized categories of personnel involved in the business organization (administrative, sales, marketing, legal, system administrators) or external parties (such as hosting providers, technical services, IT agencies) duly appointed as Data Processors under Art. 28 GDPR where required may access data.
